1. Who we are & eligibility
PYQAir is an education-technology platform that provides study material, practice tests, productivity tools, and community features for exam aspirants. You may use the Services only if you can form a legally binding contract with us. You must be at least 18 years old to make purchases. Users between 13 and 18 may use the free Services only with the involvement and consent of a parent or legal guardian, who accepts these Terms on their behalf. The Services are not directed to children under 13.
2. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately at pyqair@gmail.com if you suspect any unauthorised use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.
3. Purchases, subscriptions & billing
Certain features, books, and "PYQAir Pro" plans are paid. Prices are shown in Indian Rupees (₹) unless stated otherwise and are inclusive of applicable taxes where required. Payments are processed by our third-party payment processor, Razorpay; by purchasing, you also agree to Razorpay's terms. We do not store your full card or banking details.
- Subscriptions renew automatically for the same period at the then-current price until cancelled. You can cancel at any time before the next renewal; cancellation stops future charges but does not retroactively refund the current period.
- Access to purchased digital content is granted to your account for personal, non-commercial use and may depend on continued availability of the Services.
- We may change prices or plan features prospectively; changes will not affect a period you have already paid for.
4. Refund policy
Our products are digital goods delivered instantly. Except where a refund is required by applicable law, all sales are final and non-refundable once the content or subscription has been made available to your account. If you were charged in error, charged more than once, or never received access due to a technical fault on our side, contact us at pyqair@gmail.com within 7 days and we will investigate in good faith. Nothing in this section limits rights that cannot be excluded under the laws applicable to you.
5. Licence to use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services and the content you have lawfully acquired, solely for your own exam preparation. You must not:
- copy, resell, redistribute, sub-licence, publicly display, or share purchased content (including PDFs) with others;
- remove watermarks, notices, or access controls, or attempt to circumvent any security or usage limits;
- scrape, data-mine, reverse-engineer, or use the Services to build a competing product;
- upload unlawful, infringing, harassing, or harmful content, or misuse community and chat features;
- interfere with, overload, or disrupt the Services or any servers or networks.
We may enforce usage limits (for example, per-account download limits) to protect our content and other users.
6. Intellectual property
The Services and all content we provide — including text, books, notes, questions, software, designs, logos, and the "PYQAir" name and marks — are owned by PYQAir or our licensors and are protected by intellectual-property laws. We have prepared our materials independently and in good faith. Where third-party or previous-year examination questions are referenced, they are used for educational purposes; rights in such underlying questions remain with their respective owners. No rights are granted to you except as expressly set out in these Terms.
7. User content
You may submit content such as messages, group posts, or feedback ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, royalty-free licence to host, store, display, and use it as needed to operate and improve the Services. You are solely responsible for your User Content and represent that you have the rights to share it and that it does not violate any law or third-party rights. We may remove User Content that breaches these Terms.
8. Third-party services
The Services rely on and may link to third parties (for example, Razorpay for payments, and infrastructure and content-delivery providers). We are not responsible for third-party services or content, and your use of them may be governed by their own terms and privacy policies.
9. No guarantee of results — disclaimers
PYQAir is a study aid. We do not guarantee any particular examination result, rank, score, selection, or outcome. Success depends on many factors outside our control, including your own effort. Content is provided for general educational purposes and may contain errors or become outdated; it is not professional, legal, financial, or career advice.
To the maximum extent permitted by law, the Services and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, PYQAir and its founders, team, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or relating to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b) INR 1,000.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnity
You agree to indemnify and hold harmless PYQAir and its founders, team, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Services, your User Content, or your breach of these Terms or of any law or third-party right.
12. Suspension & termination
You may stop using the Services at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
13. Governing law & dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to the below, the courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services. The parties will first attempt to resolve any dispute amicably by contacting us at pyqair@gmail.com. If not resolved within 30 days, the dispute may be referred to binding arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in India and conducted in English. This does not prevent either party from seeking urgent injunctive relief from a court.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
